Terms of Service

These Terms of Service ("Terms") govern your use of the FitBeyond AI mobile application and related services (together, the "App"). The App is operated by an independent developer based in Thailand ("we", "us", "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old to use the App, and legally capable of entering into these Terms. The App is not intended for anyone under 18.
2. The service
FitBeyond AI helps you log food and track nutrition. You can photograph meals, scan nutrition labels, or describe food in text or by voice, and the App uses artificial intelligence to estimate calories and nutrients. The App also lets you record water, exercise, and body weight, set goals, and view your progress.
3. Not medical advice
The App does not provide medical, dietary, or health advice. Calorie and nutrient figures are estimates generated by artificial intelligence and by third-party food databases. They may be incomplete or inaccurate, and you should not rely on them where accuracy matters, for example when managing a medical condition, an allergy, or a prescribed diet. Always consult a qualified healthcare professional before making decisions about your diet, exercise, or health.
The App is a general wellness tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition.
4. Your account
Some features require an account, which you can create with Sign in with Apple or an email sign-in link. You are responsible for keeping access to your account secure and for everything that happens under it. You can delete your account at any time in the App under Settings, or by emailing us at support@fitbeyond.app. Deleting your account permanently removes your data from our servers, as described in our Privacy Policy.
5. Subscriptions
The App's core features, including AI food analysis, require a paid subscription.
- Subscriptions are billed by Apple through your App Store account, not by us.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store account settings.
- Refunds are handled by Apple under App Store rules. We cannot issue refunds directly.
- Prices may change. If they do, the change applies from your next renewal, and Apple will notify you as required.
- If a subscription lapses, you keep access to your logged data but lose access to subscription features until you resubscribe.
6. Your content
You retain ownership of the content you submit to the App, such as meal photos and food descriptions ("Your Content"). You grant us a limited, worldwide, royalty-free licence to store, reproduce, and process Your Content solely to operate and provide the App, including sending it to the AI and infrastructure providers named in our Privacy Policy for analysis and storage. This licence ends when Your Content or your account is deleted, except where retention is required by law.
You are responsible for Your Content and must have the necessary rights to submit it. Do not submit content that is unlawful or that infringes anyone's rights.
7. Acceptable use
You agree not to:
- use the App for any unlawful purpose;
- interfere with or disrupt the App or its servers, or attempt to access them other than through the interfaces we provide;
- reverse engineer, decompile, or disassemble the App, except where such a restriction is prohibited by law;
- resell, rent, or redistribute the App or systematically extract data from it;
- use the App to build a competing product or to train machine-learning models.
8. Intellectual property
The App, including its software, design, and branding, is owned by us or our licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices that you own or control, for your personal, non-commercial use, in accordance with these Terms and the App Store terms.
9. Termination
You may stop using the App at any time. We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if we discontinue the App. Where reasonably possible, we will give you notice and an opportunity to export or delete your data. Sections that by their nature should survive termination (including sections 3, 6, 10, 11, and 12) survive it.
10. Disclaimers and limitation of liability
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and accuracy of nutrition estimates. We do not warrant that the App will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill, arising from your use of the App. To the same extent, our total liability for all claims relating to the App is limited to the amount you paid for the App in the 12 months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
11. Apple
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support for it. If the App fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, to the extent provided by App Store terms; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a US government embargo and are not on any US government list of prohibited or restricted parties.
12. Governing law
These Terms are governed by the laws of Thailand, without regard to conflict-of-law rules. Disputes are subject to the non-exclusive jurisdiction of the courts of Thailand. If you are a consumer, you keep any mandatory protections of the law of the country where you live.
13. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will give you reasonable notice, for example in the App or by email. The updated Terms take effect on the date stated at the top of this page, and continuing to use the App after that date means you accept them.
